Social security for managers: things you need to know

A manager's social security depends on two factors:

  1. your company's legal status 🗽
  2. the percentage of share capital held 📃

As a company director or manager, you have two types of social security system:

  • the general employee scheme
  • the social security system for the self-employed

     

What are the differences between these two plans? 🏥

The differences between the general scheme for salaried employees and thesocial scheme for the self-employed are becoming increasingly subtle.

The social scheme for the self-employed covers and protects relatively less than the general scheme for salaried employees. Nevertheless, it costs less than the latter. For a company director, this can be a way of reducing expenses. The remaining differences concern :

  • supplementary pension: the pension for self-employed workers is equivalent to that for non-managerial employees
  • occupational illnesses: a company director covered by the general employee scheme can receive contributions from the Assurance Maladie, whereas a self-employed person can only receive a maximum equivalent to half his or her income.

Which plan for which position? 🧑‍💻

On the one hand, they are compulsorily affiliated to the to the general social security scheme and treated as employees :

  • minority or equal partners in SARLs and non-partner managers in EURLs
  • Chairmen and Managing Directors of SASU/SAS
  • Chairmen of Boards of Directors/Supervisory Boards, Chief Executive Officers and Chief Operating Officers of SAs

 

On the other hand, the following are compulsorily attached to the social security scheme for the self-employed :

  • sole proprietors
  • EURL managing partners and SARL majority managers
  • SNC partners (managers or not)
