Appealing to the public's generosity, particularly through donations, involves following strictly regulated procedures. For associations and foundations, mastering the legal rules in force and the technologies available is essential to launch, organize and succeed in their fundraising campaigns. By applying these rules and tips, they can better support their cause and maximize the impact of their campaigns.
Collecting donations from individuals is governed by precise legal rules, clarified byOrdinance no. 2015-904 of July 23, 2015. This aims to simplify the regime for public appeals to generosity for associations and foundations. Since application decree no. 2017-908 of May 6, 2017, this framework has been in force and requires that any fundraising campaign be mentioned in the organization's articles of association.
Areas covered by the collection
Donations are collected in a variety of fields:
- scientific research
- social assistance
- family support
- humanitarian actions
- philanthropy
- education
- sport
- culture
- environmental protection
Declaration procedure
Before launching a public appeal for donations, a declaration must be made to the prefecture where your association's head office is located. Decree no. 2019-504 of May 22, 2019 sets a threshold of €153,000, above which this declaration is mandatory. If an association conducts several separate collections during the same year, a declaration is required for each one.
This declaration must include information such as :
- the identity of the organization
- names of legal guardians
- collection objectives
A model declaration is provided by the Ministry of the Interior.
Responsibilities of collecting bodies
Organizations that organize fund-raising events must comply with strict accounting obligations. They must draw up an annual account detailing the use of donations received. If the funds collected exceed €153,000, the accounts must be certified by an auditor before publication in the Journal Officiel. This report must be made available to the public to guarantee total financial transparency.
Campaign monitoring
Collecting bodies may be audited by authorities such as the Cour des Comptes, in order to verify the use of funds. However, campaigns aimed at causes outside the above-mentioned areas are not subject to these rules.
Please note: online fundraising is not exempt from these legal obligations, as it can reach a national audience and is therefore subject to the same regulations.
Integrating technological innovations into fundraising
Modern technologies, such as digital, blockchain and artificial intelligence, enable associations to expand their audience and simplify transactions, strengthening their fundraising initiatives.
What advantages do these technologies offer?
Blockchain-based cryptocurrencies such as Bitcoin and Ethereum enable secure payments, while artificial intelligence facilitates data analysis and optimizes donor management.
Precautions and recommendations
These technologies remain complex for some, and their financial volatility calls for rigorous risk assessment. Before adopting them, associations need to carefully assess their resources and expertise.
Combining these digital tools with traditional fundraising methods can offer a diversified and effective financing strategy for associations.
